End User License Agreement

The rules for using Vespers

Effective July 12, 2026

This agreement is between you and Vespers (the software application and its owner, Jason McInerney). By downloading, installing, or using Vespers, you agree to the terms below. If you don't agree, don't install the app.

What you can do

You may install and use Vespers on any Mac you personally own or control. You can write with it, revise with it, back up your prose however you like, and export your work to any format Vespers supports or plain markdown at any time. Your writing is yours; nothing in this agreement gives Vespers any claim to your prose, outlines, or notes.

What Vespers costs

Vespers is free during the 1.0 launch. Future versions may be paid or subscription-based; if that changes, existing installations of a version you already have keep working under the terms you accepted at install time. You are not required to upgrade to a paid version.

What you can't do

Ownership

Vespers, its source code, its visual identity, and the Vespers wordmark are the property of Jason McInerney. This agreement grants you a limited right to use the app; it does not transfer any ownership.

Everything you create with Vespers (your prose, outlines, notes, snapshots) belongs to you. Vespers does not upload, sync, index, or access your writing.

Updates

Vespers may release updates that add features, fix bugs, or change behavior. Updates are optional; you can continue running the version you have. If an update materially changes the terms of this agreement, the change applies to the updated version, not the one you already accepted.

Ending the agreement

You can end this agreement at any time by uninstalling Vespers. The agreement also ends automatically if you violate its terms. When it ends, you must stop using the app; your locally stored writing remains yours to keep, move, or delete.

No warranty

Vespers is provided "as is," without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Writing software can crash. Back up your work.

Limitation of liability

To the maximum extent permitted by law, Jason McInerney will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or writing, arising from your use of Vespers. Total liability under this agreement, for any reason, will not exceed what you paid for Vespers in the twelve months before the claim (which, during the free launch, is zero).

Applicable law

This agreement is governed by the laws of the State of California, United States, without regard to conflict of laws principles. Any dispute arising from this agreement will be handled in a court of competent jurisdiction in California.
